I/we acknowledge, confirm and agree that:

1. If I/we do not provide Colour Create with a non-refundable booking fee for the date of reservation of your services, this agreement will lapse and be of no further force and effect (no longer valid) and you will have no obligation to render any services to me/us.
2. In the case of a lifestyle session or wedding package cancellation or a change of date by the client, if the change occurs 10 days or less before the session date for a lifestyle session or 30 days or less before the wedding date for wedding packages, the client will need to pay the booking fee again.
3. On accepting this agreement by both parties hereto, the Photographer will reserve the time and date agreed upon and will not make another reservation for the specific time frame. For this reason, all booking fees are non-refundable even if the date is changed or if the photo session/wedding becomes cancelled for any reason, all monies paid shall be retained by Colour Create in order to offset its loss of business.
4. The balance of the total amount quoted shall be due and payable and available in cash (in case of an electronic transfer) to Colour Create the week before our photo session/wedding. Failing to effect the above-mentioned payment or provide proof thereof, Colour Create can refuse to execute its mandate to take photographs.
5. The photographs will be available for download within 4 weeks after the photo session/wedding (except in the case of a rush edit). 
6. I/we will pay Colour Create’s transport costs to and from the location at the rate of $0.85 p/km in the event that our photo session or venue where our photographs will be taken is situated 30 km/50kom outside Morayfield (4506) centre and as specified in the quotation.
7. Colour Create will choose the best photographs to process from the batch of photographs taken at the photo session/wedding. We or anyone other than Colour Create are not allowed to edit the images given to us. 
8. All negatives remain the property of Colour Create. Colour Create owns the copyright to all the images. We/I are allowed to use the images on Social Media platforms and print them. We/I are not allowed to sell the images.
9. Colour Create reserves the right to use any of our photographs for advertising or marketing purposes.
10. Colour Create will take all the necessary steps required to prevent us from suffering any damage.
11. In the event that Colour Create is found liable for damages caused to us directly or indirectly, Colour Create shall be limited to the deposit amount in terms of the package quoted.
12. In the event that there is a technology failure Colour Create cannot be held responsible for the failure.
13. I/We shall be liable for payment of any postage/courier fees where applicable. Courier fees will be added to the client invoice.
14. I/We understand that Colour Create will only keep images for 8 weeks and I/we agree to make a backup of our images.
